Expert Witness Reports
It is an unfortunate fact of life that disputes frequently arise in the field of property and construction.
At UNDERWOOD Associates we have extensive experience in the investigation of disputes and the preparation of reports, produced in the correct format, in order to assist in the settlement of such disputes or alternatively for use in court proceedings. More usually our reports are prepared under directions received from solicitors however where matters have not been referred to lawyers we are usually able to advise on how best to proceed.
Typical areas of dispute on which we can advise are:
Construction Disputes
These typically involve matters of poor workmanship, design or materials, allegations against professionals engaged in a building project or matters of valuation where, for example it is considered that a contractor’s account is unreasonable.
We are able to bring a forensic approach to the investigation of such disputes by undertaking site investigations and analysing events and other relevant evidence in order to form a reasoned opinion which is backed up by a thoroughly analysed and robust report.
In matters of valuation we are able to quantify work undertaken and provide an expert opinion as to the correct value of the building work actually undertaken.
Boundary Disputes
Boundary disputes frequently arise between neighbours. They often originate when a property changes hands and owners might perceive there to be a difference between the physical boundary and that shown on the Land Registry plan.
It is not uncommon for such perceptions to arise as the Land Registry plan is not necessarily good evidence of the true boundary position.
We are able to conduct highly accurate digital surveys of land and boundaries together with analysis of all other available evidence (including aerial photographs where appropriate) in order to provide a professional opinion as to the true boundary position.
